Terms of service
The Trinity Insights General Terms of Sale (CGV) govern access to the site, the REST API, the MCP server, the dashboard and any associated feature. This page summarises the cardinal clauses for public information; the full contractual version signed by every user at checkout lives on the public marketing page.
Canonical reference
The binding contractual version is in the full General Terms of Sale (thirty articles, French law, MiCA + AMF + GDPR compliance, EU Directive 2019/770 on digital content). In case of divergence between this documentation summary and the CGV, the CGV prevails.
Usage principles
- Personal or business use allowed under a valid subscription tier.
- No reverse-engineering of the proprietary Trinity composites (TCI, TCTI, Trinity Code, TLBI, TSS, TSMI, TRI, TAI).
- No mass redistribution, republication or resale of data and indicators without prior written agreement.
- No public attribution to Trinity Insights of any individualised financial advice.
- No automated scraping outside of the tier quotas.
Subscription, billing, termination
Subscriptions are billed monthly (or annually depending on the offer) through Paddle.com acting as Merchant of Record. No minimum commitment duration is imposed ; annual subscriptions are paid in a single upfront payment for twelve (12) months in exchange for a preferential rate. Pursuant to article L.215-1-1 of the French Consumer Code (online termination requirement), the user can terminate their subscription at any time in fewer than three clicks, from the billing portal or the dashboard, with no fees or penalty. No prorata refund is granted on the annual period already paid. For the Founding offer, the preferential rate is kept as long as the subscription stays active and continuous, any cancellation results in the permanent loss of the Founding rate. See CGV articles 3 and 13 for the details.
Intellectual property
All indicators, methodologies, algorithms, exclusive composite scores and interfaces of Trinity Insights are the exclusive intellectual property of Trinity Insights. The subscription grants a personal, non-exclusive and non-transferable license to use. Any reproduction, redistribution, resale or reverse engineering is strictly forbidden. Full clause at CGV article 14.
Limitation of liability
The service is provided « as is ». Trinity Insights' liability is capped at the total sums paid by the user during the previous twelve (12) months. No liability for indirect losses, lost profits, data losses, reputational damages or consequential damages, including investment decisions made on the basis of the published indicators. See CGV article 11 and the Legal disclaimer sheet for the data accuracy context.
Force majeure
Non-performance excused in case of force majeure within the meaning of article 1218 of the French Civil Code (natural disaster, pandemic, armed conflict, major cyber-attack, third-party infrastructure outage, governmental or judicial decision, network interruption). See CGV article 16.
Modification of terms
Trinity Insights may evolve the service and the terms. Substantial changes are communicated by email with at least thirty days' advance notice before entry into force. Continued use after notification means acceptance ; a user who refuses may terminate without fees before entry into force. See CGV article 15.
Personal data and confidentiality
Personal data processing is governed by EU Regulation 2016/679 (GDPR) and the French Loi Informatique et Libertés. Details in the Privacy policy, the sub-processors list and the GDPR documentation sheet.
Applicable law, jurisdiction and mediation
French law applies. Paris courts have jurisdiction, subject to the mandatory provisions of the French Consumer Code in favour of the consumer (article R631-3) who may seize the court of their domicile. For consumers residing in the EU, EU Regulation 1215/2012 Brussels I bis (article 17) and EC Regulation 593/2008 Rome I (article 6) guarantee the application of the mandatory provisions of the country of residence. See CGV article 27.
Before any litigation, the consumer user may freely refer the matter to the consumer mediator under article L.616-1 of the French Consumer Code. Mediator contact details at CGV article 22.
Indemnification by business users
Business users (B2B) agree to indemnify Trinity Insights against any claim, action, damage, loss or cost (including reasonable attorney fees) resulting from their breach of these terms, from unauthorised redistribution of the content, or from any false or misleading public statement attributing to them an individualised financial advice.
